a. 1. B. Describe the Process Used for Designating Local Areas, Including Procedures for Determining Whether the Local Area Met the Criteria for “performed Successfully” and “sustained Fiscal Integrity” in Accordance with 106(b)(2) and (3) of WIOA. Describe the Process Used for Identifying Regions and Planning Regions Under Section 106(a) of WIOA. This Must Include a Description of How the State Consulted with the Local Boards and Chief Elected Officials in Identifying the Regions.

Current Narrative:

If the chief elected official and Local WDB in a local area submitted a request for initial designation, the Governor did approve the request if, for the 2 program years preceding the date of enactment of WIOA, the following criteria were met: (1) The local area was designated as a local area for purposes of WIA; (2) The local area performed successfully by meeting or exceeding the levels of performance the Governor negotiated with the Local WDB and chief elected official under WIA sec. 136(c) for the last 2 full program years before the enactment of WIOA, and that the local area has not failed any individual measure for the last 2 consecutive program years before the enactment of WIOA. (3) The local area sustained fiscal integrity and was not found in violation of one or more of the following during PY 12 and PY 13: • Final determination finding(s) from audits, evaluations or other reviews conducted by state or local governmental agencies or the United States Department of Labor which identify issues of fiscal integrity or improperly expended funds due to the willful disregard or failure to comply with any WIA requirement. This includes failure to grant priority of service or verification of participant eligibility; or • Gross negligence, defined as a conscious and voluntary disregard of the need to use reasonable care, which is likely to cause foreseeable grave injury or harm to persons, property or both; or • Failure to observe accepted standards of administration. Local areas must have adhered to the uniform administrative requirements set forth in Title 2 CFR Part 200 and Title 29 CFR Parts 95 and 97. Local areas must have fully met their federally-mandated responsibilities for the two previous program years, including timely reporting of WIA participant and expenditure data, completed and submitted the required annual single audit and not having been placed on cash hold for longer than 30 days. (WIOA Section 106(e)(2)) (i.e. failure to submit timely expenditure reports to LWC). The initial designation requirements and application procedures are described in Louisiana Workforce Commission Policy OWD 4-10 which is shown below. http://www.laworks.net/Downloads/WIOA/LWC_4-10-WIOAInitialDesignation.pdf

With regard to subsequent designation, the Governor must review all local areas that were initially designated under WIOA before submitting the State Plan during each 4-year State planning cycle to evaluate whether the area continues to meet the requirements for subsequent designation. The local area and chief elected official must be considered to have requested continued designation unless the local area and chief elected official notify the Governor that they no longer seek designation. Subsequent designation will be granted if: 1. The local area performed successfully by meeting or exceeding the levels of performance the Governor negotiated with the Local WDB and chief elected official for Program Years 2016 and 2017 and the local area has not failed any individual measure for Program Years 2016 and 2017. 2. The local area sustained fiscal integrity and was not found in violation of one or more of the following during PY 2016 and 2017: • Final determination finding(s) from audits, evaluations or other reviews conducted by state or local governmental agencies or the United States Department of Labor which identify issues of fiscal integrity or improperly expended funds due to the willful disregard or failure to comply with any WIOA requirement. Local areas must have fully met their federally-mandated responsibilities for the two previous program years, including timely reporting of WIOA participant and expenditure data, completed and submitted the required annual single audit and not having been placed on cash hold for longer than 30 days. (WIOA Section 106(e)(2)) (i.e. failure to submit timely expenditure reports to LWC).
