III. b. 5. A. iii. Dislocated Worker Employment and Training Activities in Accordance with WIOA Section 133(b)(2) and Based on Data and Weights Assigned

Current Narrative:

Dislocated worker funds are formula-allocated to local areas based on a formula developed in partnership by the state workforce agency, the Colorado Workforce Development Council, local elected officials, and local workforce areas, and approved by USDOL. The determining factors and their weights are: 1) Share of insured unemployment (20%), Share of number served (20%); Share of percentage of expenditures (15%); Share of declining industry (10%); Share of farm/ranch in crisis (5%); Share of unemployment insurance claims open longer than 15 weeks (25%); and Share of federal fiscal year unemployment (5%). Then a minimum provision is applied so that no local area receives less than 90% of the average allocation percentage of the local area for the 2 preceding fiscal years per WIOA 133(b)(2)(B)(iii).

Colorado is using a zero factor for Plant Closing and Mass layoff per the following justification: “A description of how the Governor’s formula is appropriate to distribute funds equitably throughout the state.” The Governor’s formula, approved by USDOL has two added factors: the percent share of dislocated workers served in the previous fiscal year by each local area, and the percent share of dislocated worker formula funding spent in the previous fiscal year on dislocated workers by each local area. This formula has provided an equitable method of distribution based on the need demonstrated by a local area’s use of funds and continuing provision of services to dislocated workers. It has also served as an incentive for local areas to retain  a percentage of their DW funding for services to this population (rather than transferring all of the funds to the Adult program) to address ongoing layoffs and business closuresIn addition, a process has been established and is captured in state law whereby local elected officials can request to review and propose a revision to the formula on an annual basis. If a review is requested, the suggested revised formula is forwarded to the CWDC for review and submission to the governor, before submission to USDOL for approval.
